Finding a Lawyer in Australia.

Some people have asked the easy way to find a lawyer in Australia.

Some of these questions are in relation to preparing a Visa Application.

Most people choose a Migration Agent for Visa Applications, as they are registered with the Office of the Migration Agents Registration Authority (OMARA), which is a section within the Department of Home Affairs.

The Office of the Migration Agents Registration Authority [OMARA] investigates complaints about registered migration agents, which can help to protect consumers.

OMARA keeps a Register of registered migration agents, checks that registered migration agents maintain the knowledge they need to give clients accurate advice, handle complaints about registered migration agents and discipline registered migration agents when they don’t meet the Code of Conduct.

Find a Registered Migration Agent.

Using a Lawyer in Australia

An Australian lawyer handles many different activities, from Divorce, Criminal defence, business transactions, etc.

A lawyer is not a registered Migration Agent, and is not under the same rules.

There are some Lawyers that do have experience with Immigration matters, but the majority will not. These are still not under the rules of the OMARA, but are covered by each States Law Society rules.

The Migration Amendment (Regulation of Migration Agents) Act 2020 which required the removal of lawyers from the regulatory scheme administered by the Office of the Migration Agents Registration Authority (OMARA).

However, from 22 March 2021, a lawyer may provide immigration assistance without being a registered migration agent (RMA).

The Queensland Law Society does have a list of lawyers that have at least three years substantial experience in immigration matters.
