Prospective Marriage (subclass 300) visa holders Exempt from Travel Ban, but not all.

Some Prospective Marriage (subclass 300) visa holders can now travel to Australia.

If you applied for a subclass 300 visa on or before 18 August 2020, and you have now been granted your subclass 300 visa; you are eligible for an inwards travel exemption on 18 August 2021.

Travel exemptions for PMV holders

The Commissioner of the Australian Border Force and decision makers may grant you an individual exemption if:

You are eligible in the following circumstances:

  • where the subclass 300 visa has been granted; and
  • the subclass 300 visa application was lodged at least 12 months before submitting a travel exemption request.

According to the above page, a 300 visa holder is not automatically exempt, and does need to apply for the exemption.

Question:

  • Why has the Government chosen to block this partner visa class from entering Australia to marry their Australian partners?

Answer:

  • Holders of Prospective Marriage (Subclass 300) visas are not necessarily deemed immediate family members and their requests are considered on a case by case basis. A person’s intention to marry their fiancé is not sufficient, in and of itself, to satisfy the definition of de facto partner.
  • A Provisional Partner (Subclass 309) visa holder has been assessed as meeting the definition of spouse or de facto partner as part of the visa application process and is therefore considered immediate family for the purposes of an inward travel exemption.

Have Prospective Marriage visa holders been granted a Travel Ban Exemption before this?

Yes.  There have been some PMV holders that have applied for a travel ban exemption, and been granted one, due to proving sufficient information to be deemed immediate family members.
