What is the difference between a Registered Migration Agent (RMA) and a Lawyer?
An example of a statement on a lawyers website is: “our purpose is simple – providing exceptional representation in criminal and traffic law throughout the State of Queensland”.
Some Lawyers specialise in business transactions, others in divorces, others in property transactions.
Lawyers are allowed to help with migration applications, but with no protection under MARA.
A lawyer specialises in law, they can do other things if they wish. Some have been involved in some complex migration cases where unusual legal issues crop up.
A migration agent specialises in Migration, and probably nothing else. They may get a lawyer involved if needed (as mentioned above).
A migration agent is regulated by MARA, an Australian Government authority that registers migration agents and regulates the Migration Agents profession.
A lawyer can no longer register as a migration agent at MARA.
The Migration Amendment (Regulation of Migration Agents) Act 2020 requires the removal of lawyers from the regulatory scheme administered by the Office of the Migration Agents Registration Authority (OMARA).
