Reason for S57 Letter.
One main purpose of the section 57 Natural Justice Letters are to give the applicants a final opportunity to recover from what is probably a visa refusal.
Some visa applicants receive a section 57 Natural Justice Letter, during their visa processing.
These are normally for applicants that have serious issues with their application that might be considered fraud or misleading.
These can sometimes be easy to respond to, but at other times it can be a nightmare.
One example, that I have been told about, is an applicant for a visa who previously applied for a visa in Canada, but had been refused.
They did not mention that refusal in their Australian visa application, thinking that no-one would know.
They were wrong.
Immigration departments in some countries share this sort of information with other countries.
The S57 natural justice letter was asking the application to comment on their omission of important information.
Immigration might already know the details for the Canadian visa refusal.
- A poorly written response could easily lead to a refusal.
- A good response “might” still result in a grant.
Some people are advised by an agent to withdraw such an application, rather than risk a refusal.
