The Subclass 116, Offshore Carer visa, allows the holder to move to Australia to care for someone with a long-term medical condition who has no reasonable access to care options in Australia.

The Visa applicant must be a relative or family member of a relative that lives with that relative.

The Visa applicant must fully understand the sponsor’s medical condition and care needs, and be able to provide ongoing substantial care and continuing support or assistance to their sponsor.

This is a permanent visa.

The cost is $1,795 as the first instalment payable at time of application, with a further second instalment of $2,065 payable when requested by immigration.

Carer Visa Requirements:

The main obstacle, that many applicants find, is the “time of decision” criterion (clause 116.221) under Regulation 1.15AA.

Regulation 1.15AA specifies that the person requiring care must be an Australian citizen, permanent resident or eligible New Zealand citizen who has a medical condition that is causing impairment of the person’s ability to attend to the practical aspects of daily life, and who, because of that condition, has and will continue for at least 2 years to need direct assistance with the practical aspects of daily life.

To obtain the Carer Visa, the Applicant must prove that the assistance required by the person requiring care ‘cannot reasonably be provided by any other relative of the person who is an Australian citizen, permanent resident or eligible New Zealand citizen, or obtained from “welfare, hospital, nursing or community services in Australia”.

Subclass 116 visa processing times:

Immigration do not provide processing times for this visa, as applications are subject to capping and queueing.

Some applicants have waited up to about 5 years.
