Does Australia give Birthright Citizenship.

Prior to 20 August 1986, almost anyone born inside Australia, no matter what visa they held, became an Australian Citizen.
An Australian Birth Certificate was enough to get an Australian passport.

However the Australian Citizenship (Amendment) Act 1986 made a major change to that, and meant that children born in Australia, on or after 20 August 1986, would only be Australian citizens if at least one parent was an Australian citizen or permanent resident.

Full birthright citizenship in Australia effectively ended on 20 August 1986.

What is Birthright Citizenship?.

Birthright Citizenship normally refers to the right of anyone born in the country to become a citizen of that country automatically, as it does in the US.

This ended in Australia on 20 August 1986.

The general rule for Australia is that anyone born in Australia, to an Australian Citizen or a Permanent Visa holder, becomes an Australian citizen. This was one effect of the 1986 changes.

Rules on the Birth of Children with Australian Connection.

Children born in Australia, where a parent is not an Australian Citizen or Permanent Resident visa holder, at the time of the child’s birth, will hold the same visa as the parent.
ie: If the parent holds a Visitor Visa, so will the child.

Children born in Australia with at least one parent who is an Australian citizen or permanent resident at the time of the child’s birth, automatically acquire Australian citizenship.
Children born in Australia, where a parent is not an Australian Citizen or a Permanent Visa holder, but is allowed to live in Australia for the next ten years, is able to apply for Citizenship.

Children born outside Australia to an Permanent Resident parent, will need to apply for and be granted a permanent visa to be able to enter and remain in Australia with their parents.
Children born outside Australia to an Australian citizen parent, will automatically acquire Australian citizenship.
