A few people have mentioned issues regarding getting a Partner visa before their Student Visa expires.
One such example mentioned that they were told by their agent that they can’t even apply until their Student Visa expires. I am not sure if that was an Education Agent with little knowledge of Partner Visas, or a Migration agent who was just misunderstood.
However, I was 99.99% sure that a Student Visa holder can apply for a partner visa at any time, and get it granted even before the Student Visa expires.
820 Granted before Student Visa Expiry date:
Student Visa expiry date November 2021.
820 Applied 15 Mar 2021, granted on 9 Jun 2021, 5 months BEFORE Student Visa Expiry date.
Bridging visa was never activated.
Student Visa expiry date July 2021.
820 Applied Feb 2021, granted on 8 May 2021, 2 months BEFORE Student Visa Expiry date.
Bridging visa was never activated.
820 Applied before Student Visa Expiry date:
Student Visa expiry date Mar 2021.
820 Applied Jan 2021. Applied 2 months BEFORE Student Visa Expiry date.
Bridging Visa came into effect Mar 2021.
820 granted on 31 May 2021.
Student Visa expiry date September 2019.
820 Applied 28 May 2019. Applied 4 months BEFORE Student Visa Expiry date.
Bridging Visa came into effect Sep 2019.
820 Granted on 3 Feb 2021.
801 Eligible 28 May 2021, 801 granted 9 June 2021.
The Bridging visa is normally granted on submission of the Partner visa application, and payment, but is not active while the current visa is active.
The Bridging visa is automatically activated only when the Student Visa expires.
But of course, if the 820 is granted before the Student visa ends, the Bridging visa never even comes into play, as it is not needed.
The 820 Partner visa grant automatically over-rides the Student visa.
